摘要：公益诉讼制度兴起的根本原因是政治国家维护公共利益的"失灵"和能力不足,公益诉讼制度的本质是通过公民或社会组织的直接出场,促使市民社会与政治国家之间、司法权与行政权、立法权之间理性及良性互动。公益诉讼的启动权应当属于权利,而不是权力或义务。民事公益诉权不能单纯授予法律规定的国家机关或有关组织,公民是启动公益诉讼的始源"动力";公民或社会组织发动公益诉讼,应当建立诉前通知国家行政机关或肇事源;公民或社会组织与国家机关都有权申请加入对方已经提起的公益诉讼。
The fundamental reason for the rise of public interest litigation systems is states＇ failure or incapability to protect public interests. The nature of public interest litigation is to promote the rational and positive interaction between civil society and political states, and between judicial power and administrative and legislative power, by the direct presence of citizens or social organizations. The right of initiating public interest litigations should be a kind of right instead of power or obligation. The litigious right in civil public interest litigation should not be granted only to state organs or relevant organizations that are provided by law. Citizens are the original driving force for initiating public interest litigations. When they initiate public interest litigations, citizens or social organizations should inform state administrative organs or trouble makers before the litigations. Both citizens or social organizations, and state organs are entitled to apply for joining in the public interest litigations that the other side has lodged.
