摘要：高速公路属于公物,高速公路所有者或管理者与使用者之间的关系属于公物利用法律关系。因此,应在公物法视野下界定高速公路通行费,突出体现高速公路的公共属性。在对高速公路通行费进行法律规制时,应加强公物立法工作,将高速公路纳入公物法的调整范畴,积极构建政府、高速公路管理者和经营者、高速公路使用者之间良好的互动机制,确保高速公路通行费的合理性。同时,还应建立高速公路通行费争议的公法救济机制,保障高速公路使用者的基本权益。
Highway belongs to public property,the relationship between the owners or managers of highway and users of highway is public property using legal relationship.Therefore,we should define highway tolls in the perspective of the public property law,and incarnate it’s public nature.In the legal regulation on highway tolls,should strengthen the public property legislation,bring highway into the adjustment of public property law,build effective interactive mechanism between the government,the highway management and operators and highway users,to ensure the rationality of highway tolls.At the same time,we should establish public law relief mechanism for highway tolls controversial,guarantee the basic rights of highway users.
