摘要：抢劫是一种多发且性质十分严重的暴力性犯罪。抢劫罪的基本特征是以非法占有为目的,使用暴力、胁迫或者其他方法,强行劫取公私财物。它侵犯的法益既包括他人的财产权,又包括他人的人身权。暴力是抢劫的主要实现路径之一,其表现形式多样。通过探讨暴力的特征、分析暴力的程度标准及其认定、探索暴力与获取财物的关系准确把握抢劫罪中暴力的性质与特点。
Robbery is a kind of multiple crime and a serious violent crime. The basic characteristics of robbery is the illegal possession on purpose. Violence,coercion or other methods are used to rob the public and private property. In addition to property or the interests of property,it also violates the personal rights of others. Violence is one of the ways to realize the robbery and the forms are various. The paper discusses the characteristics and the degree of violence,analyzes the relationship between violence and the acquisition of property,and points out the difference of violence between the crime of robbery and extortion so as to grasp the nature and characteristics of the violence of the robbery.
