摘要：实践中,行政机关单方变更、解除权的滥用已经成为行政协议纠纷的重要原因。而比例原则在对行政机关单方变更、解除权的限制方面具有深厚的理论和实践基础。从司法裁判的立场看,法院在判断公共利益方面,采用的是法定的公共利益需要标准;在比例原则的审查强度方面,维持在中等水平。从权力限制和权利保护的角度,重新检视比例原则的具体情况,本文提出应当修正公共利益的界定标准,并结合相关要素调整比例原则的审查强度。
In practice,the abuse of the unilateral alteration and cancellation right of administrative bodies has become a major cause for administrative agreement disputes.The principle of proportionality has a pro?found theoretical and practical basis for restricting the unilateral alteration and cancellation right of admin?istrative bodies.From the perspective of judicial adjudication,the court adopts the standard of legal public interest needs in judging public interests,and the review intensity of the proportionality principle maintains on a medium level.From the perspective of restricting power and protecting rights,specific situations of the proportionality principle should be reviewed.It is proposed that the defining standards of public interests should be revised,and that the review intensity of the proportionality principle should be adjusted in com?bination with related elements.
