摘要：学术界对出版物封面设计知识产权保护讨论中,既有著作权保护一元论,又有著作权、反不正当竞争保护两元论,还有著作权、商标权、反不正当竞争保护三元论和著作权、专利权、商标权、反不正当竞争保护四元论。一元论对封面设计保护不足;以对封面设计元素解构提出的三元论,本质上是基于封面设计作为一个整体的著作权与反不正当竞争保护两元论;四元论中的专利权和商标权保护值得商榷;多元论中赞同两元论,不赞同三元论和四元论。封面设计应以著作权保护模式为首选,以反不正当竞争保护模式为例外和补充。从解构视域出发,存在与封面设计有关的知识产权保护模式,还有独立主张商标权模式或著作权与商标权相结合模式,独立主张反不正当竞争模式或慎重选择的著作权和反不正当竞争相结合模式。
Scholars has been discussing the protection of the intellectual property rights of publication’s cover design,which includes copyrights protection monism,the dualism of copyrights protection and anti-unfair competition,the ternary pattern of copyrights,trademark rights,anti-unfair competition,and the quaternion of copyrights,patent rights,trademark rights and anti-unfair competition.Monism has insufficient protection for cover design.The ternary pattern proposed for the deconstruction of cover design elements is essentially based on the dualism of cover design copyright as a whole and the protection against unfair competition.The protection of patent and trademark rights in the quaternion is questionable.In view of pluralism,dualism is preferable,but ternary pattern and quaternion are never considered.Cover design should be as the priority of copyrights protection,and anti-unfair competition should be the exception and supplement.From the perspective of deconstruction,there are intellectual property protection models related to cover design such as the independent claim of trademark rights model,and the combination of copyright and trademark rights,and independent claims of anti-unfair competition model,and the model carefully selected by the combination of copyright and anti-unfair competition.
