摘要：我国城市流动商贩因未经过商事登记取得营业执照而被认定为非法经营。然而,从商事登记促进交易便捷、保障交易安全、便于政府监管征税的制度目的看,城市流动商贩经营不履行登记并不损害商事登记的功能。商事登记的种种成本也是流动商贩作为小规模经营者难以承担的。因此,为保护弱势群体的生存需求,对城市流动商贩应允许不经商事登记而成为合法的商事主体。
Our country＇s city peddlers are considered to be illegal business without business registration to ob- tain a business license. However from the commercial registration＇s goal of promoting the convenience of transac- tion, guaranteeing security of transaction, facilitating supervision of government and collecting tax, the operation of city peddlers without performing registration wouldn＇t impair the function of commercial registration. As for all kinds of cost of commercial registration, it is difficult to bear for peddlers as the small-scale business operators. So the city peddlers should be allowed to become legal commercial subjects without business registration to protect the living needs of vulnerable groups.
