摘要：公立高校与学生之间的特别权力关系因不利于法治建设,受到广泛质疑,现行授权理论又不能穷尽高校所有的行政行为,导致大量的行政行为游离于行政法控制之外,建议重构行政主体概念,用行政法规范高校与学生的关系维度,使公立高校走出法治真空。
The special power relations between public colleges and the students have met with extensive questioning from the public for not conducing to the construction of the rule of law. The authorization theory currently in effect cannot cover all the administrative behaviors of colleges, which causes the dissociation of a lot of administrative actions from the control of administrative law, It is suggested that the concept of administrative subject status should be reconstructed so that we could use administrative laws to normalize the dimensionality of the relations between colleges and the students, allowing public universities to go out of the legal vacuum.
