摘要：新闻侵权与一般侵权行为相比具有许多特殊性,新闻侵权的作品是否发表,是判断损害事实是否存在的关键;不同的新闻侵权对象,会有不同的表现形式、构成要件;违法性是区分侵权与正当的新闻监督、新闻自由舆论的标准。确定新闻侵权的构成要件要平衡好新闻自由与人格权保护。
Compared with the ordinary infringement,news infringement has many specialties.Whether the works infringed is published or not is the key to judge the damage.Different news infringement has different form and constitutive requirements.The standard to distinguish infringement from just news supervision should be illegality.To determine the constitutive requirements of news infringement is to balance news freedom and the protection of personal right.
