摘要：我国刑法有关环境犯罪的规定没有体现保护环境预防为主的原则,这是近代人类中心主义法律价值观的体现。同时控制模式也存在结构性疏漏,刑罚措施不科学,缺乏非刑罚措施等,导致刑法在保护环境上乏力。
The stipulations concerning environment crimes in the Criminal Law of our country don＇t focus on the principle of environment protection, which embodies the modern human- centered legal value. In the Criminal Law, there also exist structural careless omissions in restricting modes, unscientific penalty measures, and lack of non- penalty measures etc. which result in the weakness of the Criminal Law in protecting the environment.
