摘要：自“中兴事件”以来,企业刑事合规逐步进入我国法律视野,对此司法实务部门和法律理论界已经进行了广泛的试点和充分的研究。但该制度对企业犯罪处置的正当性仍然存在僭越刑事法定原则、与单位犯罪基本理论不符以及偏离司法公正理念等争议。企业刑事合规可以在企业面临司法机关审查起诉时,帮助企业否定犯罪故意、切割企业刑事责任以及修复企业犯罪侵害法益;同时企业刑事合规契合预防单位犯罪的目的,符合宽严相济刑事政策的要求。
Since the“ZTE incident”,corporate criminal compliance has gradually entered China’s legal vision,for which judicial practice and legal theory have been widely piloted and fully researched,but there are still some disputes about the legitimacy of the system for the disposal of corporate crime,such as infringement of the principle of criminal law,inconsistency with the basic theory of unit crime and deviation from the concept of judicial justice.The corporate criminal compliance can help enterprises deny criminal intent,cut corporate criminal liability and repair the legal benefits of corporate crime when enterprises face judicial review and prosecution.At the same time,corporate criminal compliance is in line with the purpose of preventing unit crimes and the requirements of the criminal policy of leniency and severity.
