摘要：审判中心有利于减少来自侦控方的不当制约,使审判者成为真正的审判者。审判中心的实现需要控辩结构的动态平衡,其中主要是充分保障被追诉人的律师辩护权。在委托辩护受诸多因素限制的前提下,根据法治国家的经验,应当大幅扩大指定辩护的覆盖面。只有如此,审判中心才能实质上实现公正。
The trial center is propitious to reduce undue constraints from the prosecution so that the judge becomes the real judge. The realization of the trial center be from a dynamic balance of the prosecution and defense structure, which mainly is sufficiently to protect defense right of accused form lawyer. According to the experience of country under the rule of law, On the premise of that commission defense be restricted by many factors, the coverage of the appointed defense should be substantially expanded. Only in this way, the trial center can achieve justice in essence.
