摘要：我国《著作权法》有关期刊出版权的规定无法有效保障期刊社的正当出版利益,也无法通过期刊整体的著作权或者通过合同约定取得出版权的方式进行有效补救。对此,我们应在明确期刊社正当出版利益的基础上对期刊出版权的规定进行修正,以首发权取代禁止一稿多投规则,对法定转载权进行期限限制,并适度扩张出版权适用范围。
The provisions of copyright law of P. R. C. has the lack of the protection for due interest of periodical publisher. This lack cannot be compensated through the whole copyright of periodical and acquiring publishing right by contract. In order to acknowledge and protect the due interest of periodical publisher, the law should be revised as follows： the right of exploitation replacing the rule of one-paper-submitted-to-several-journals, time limiting on the statutory digest right, and expanding the scope of application of publishing right.
