摘要:富勒将法学教育的目标界定为“培养作为社会结构建筑师的法律人”,其核心在于增进学生对立法、司法过程的理解,从而发现“社会秩序的自然法”。此种法学教育观的理论渊源在于程序自然法理论,其背后的理论根据在于“融合命题”与“理性命题”。尽管此种法学教育观的根基有待夯实,但其强调的“社会秩序的自然法”与法学教育目标的关联对于中国法学教育尤其具有启发意义。中国的法学教育要培育作为中国社会结构建筑师的法律人,要让学生于社会归序过程中洞悉中国社会秩序的实践难题问题并提出理性的解决方案。
Fuller defined the objective of legal education as cultivating the lawyer as an architect of social structures.Its core lays at improving students????understanding of the legislative progress and adjudicative process,so as to discover the natural laws of social order.This conception of legal education originated from the procedural natural law theory which based on the Fusion Thesis and the Rationality Thesis.Although the foundation of this conception of legal education needed to be strengthened,its emphasis on connection between the natural laws of social order and the objective of legal education had enlightening significance for China's legal education.China's legal education should cultivate the lawyers as an architect of chinese social structures and enable students to understand the practical problems of China's social order in the process of social ordering and put forward rational solutions.
