摘要：环境侵权行为是环境法的基础性概念,其内涵的认定与环境侵权救济法的诸多问题密不可分,如环境侵权民事赔偿的范围、环境侵权救济的方式、环境侵权采用的诉讼途径等。何谓环境侵权行为?一直以来,我国环境法学界众说纷纭,莫衷一是。2009年12月26日审议通过的《侵权责任法》关于环境侵权行为的规定与学者们的观点存在很大差异。环境侵权行为的认定关键在于厘清其客体,而客体的明晰又必须对环境权作出正确的把握。
Environmental violations are the basic concepts of environmental law,its content identification and environmental tort Relief Act are closely related,such as the environment,the scope of infringement of civil compensation,environmental tort relief methods,and environmental tort litigation.But the definition of is environmental violations is still at issue among the experts The provisions on environmental tort in ＂Tort Liability Act＂ discussed and adopted on 26th,Dec.2009 are disagree with the scholars.The key to the identification of environmental violation lies in clarifying its object,while the clarity of the object depends on the correct grasp of the environment right.
