摘要：专家组和上诉机构的报告中经常引用WTO协定以外的条约,这些非WTO条约有的已被并入WTO法律体系,其地位类似于WTO协定,可以作为法律渊源被DSB适用,没有被并入的非WTO条约不能作为法律渊源而适用,但可以成为DSB在解释WTO协定时的援引渊源。
Non-WTO treaties have always been cited by the Panel Reports and the Appellate Body Reports. Some of these non-WTO treaties become incorporative treaties because of the incorporation by the provisions of WTO agreements and the application of incorporative treaties should be recognized agreements. The non-WTO treaties not incorporated can＇t be applicable laws to DSB, the sources of laws for legal interpretation by the DSB. as the application of WTO yet they can be invoked as
