摘要：生态价值是农地的重要价值形态,而我国现行《刑法》之"破坏环境资源保护罪"保护的主要是农地的经济价值而非生态价值。这种单一的价值选择已经严重滞后于保护农地生态价值的现实需求。刑法是保护农地生态价值的最后一道屏障,我国应该建构独立的农地生态价值保护体系,从立法技术上实现农地生态价值保护的专门化、类型化和可测量化。
Ecological value is an important value form of farmland,the main protection of"crime of destroying environmental resources protection"is that the economic value of agricultural land resources is not its ecological value.This kind of economic farmland environment crime mechanism has seriously lagged behind the actual demand of controlling farmland ecological crime.Ecological legal interest,as the embodiment of ecological standard and ecological value in the era of ecological civilization,should be protected by criminal law.We should establish and recognize the independence and systematization of farmland ecological crime,from the aspect of legislation technology,the legal interest should be specialized,typed and measurable.
