摘要：'容错纠错'属于党纪政纪问题还是法律问题,目前缺乏界定。物质的多样性、物质的发展观及唯物主义认识论决定人们对事物本质的把握是一个逐步深化的过程;改革创新不可避免会犯错。具体行政决策的权力来自人民,决策者必须对人民负责,对于不可避免的错误需合法且尽力地防错和纠错才能被宽容。容错过程尽管涉及党纪政纪,但本质属于对具体行政决策监督及救济的法律问题。容错法律关系需要突破传统行政管理关系理念,以构建国家与公民平等秩序的理念为依据进行构造。容错法律关系是建立容错纠错法律机制的法理基础。
Whether'error tolerance and correction'belongs to the issue of the Party discipline,government discipline or legal power is not defined at present.Material diversity,material development concept and materialist epistemology determine that people’s grasp of the essence of things is a gradual deepening process,thus reform and innovation will inevitably lead to mistakes.The power of specific administrative decisions comes from the people,who must be accountable to the people.The inevitable mistakes must be prevented and corrected legally and diligently in order to be tolerated.Although tolerance process involves Party discipline and government discipline,it essentially belongs to the legal right to supervise and remedy specific administrative decisions.Fault-tolerant legal relations must be constructed on the basis of the idea of building an equal order between the state and citizens by breaking the concept of traditional administrative management relationship.The legal relationship of fault tolerance is the legal basis of establishing the legal mechanism of fault tolerance and correction.
