摘要：2012年我国《刑事诉讼法》的修改为未成年人羁押必要性审查作出了框架性规定,但仍然面临着高度依赖成人刑事司法、立法规定不明确以及专业司法机关缺乏等现实困境。然而,实践中的未成年人羁押必要性审查模式体现了少年司法的改革成果:"检察中心主义",其目的在于检察阶段建立分流程序。社会调查报告制度实际上为分流程序提供前提条件,刑事和解、符合监护条件成为羁押必要性的阻却理由。当然,建构未成年人羁押必要性审查模式或者"检察中心主义"的未来有待于社会化支持机制的完善。
The amendment to the criminal procedural law of 2012 has made framework to detention necessity for review of juvenile. But it still faced the dilemma , dependent on criminal justice, legislation is not clear, and the lack of the professional judicial organs, what is more important, The mode of juvenile detaining necessity review in practice has constructed ＂procuratorial centralism＂, aimed to establish diversion procedure in the prosecution stage, social investigation report is the premise condition , Criminal reconciliation has became the justification for inhibition of crimes. Of course, the construction of framework to juvenile detaining necessity and the future of ＂procuratorial centralism＂ rely on improving the social support mechanism.
