摘要：当今世界范围内,恐怖主义犯罪频繁发生且危害后果日益严重,打击恐怖犯罪活动成为世界各国的共同和重要任务。与实体法相比,程序法对规制恐怖主义犯罪具有独特的作用和价值。我国现行法律对恐怖主义犯罪虽有一些程序法规定,但与其他国家相比,在刑事司法理念、特别诉讼程序、刑事强制措施、犯罪证明标准、相关人员人身保护等方面均存在不足,与建设和谐社会、维护社会秩序、增强人民群众安全感的需要等目标不相适应。应当从树立正确的司法理念、加强对相关人员的人身保障、细化技术侦察措施、提高恐怖主义犯罪证明标准、增设特别程序和分区域设置专审法院等方面进一步改进和完善。
Nowadays, terrorist crimes occur frequently, and the consequences of the crimes are becoming in- creasingly serious. Therefore, combating terrorism crimes countries in the world. Although there are some procedural has become a common and important task for all provisions in Chinag current law against the crimes of terrorism, compared with those of other countries, there are deficiencies in judicatory ideas, special pro- ceedings, criminal coercive measures, crime proof standards and personal protection of related personnel, which is incompatible with such goals as building a harmonious society, maintaining social orders and enhan- cing people~ sense of security. Correct judicial concepts should be established, the personal protection of rele- vant personnel should be strengthened, technical investigation measures should be refined, the standard of proof for the crimes of terrorism should be raised, and greater improvements should be made in such aspects as establishing more special procedures and setting up regional special trial courts
