摘要：在我国宪法框架内,"计划生育"是作为生育权限制的制度形式,其对于人口的调控应适应经济发展与社会发展计划的需要。"计划生育"重构于比较法学中的"生育控制"理念,生育权的自由属性与社会经济发展的适度匹配,阐释了生育控制的必要性与所应保有的制度底线。中国计划生育制度的实践表明,其调控方式经历纯粹的政策主导,再到形式法治的治理,最终迈进实质法治范畴。而要彻底实现实质的法治,必须对"计划"作出清晰的内涵判断,以实现政策工具和法律机制的无缝衔接。藉由计划生育制度宪法条款的全面实施来完成计划生育制度的转型:即由人口调控的经济主义单轨制转型至兼顾社会发展中社会主体权利实现的双轨制,才是未来计划生育制度调整的宪法正道。
Within the framework of China＇s constitution, Family Plan is an institutional form to restrict the right of birth. Its role of adjusting the population should be adjusted to conform with the needs of economic and social development plan. The concept Family Plan was re-constructed from the concept ＂birth control＂in comparative jurisprudence, in which the attribute of freedom of birth right matches moderately with socialeconomic development, This can explain the necessity of birth control and the institutional baseline. The practice of Family Plan policy shows that its adjusting methods have changed from pure policy domination to governance of formal rule of law and finally to substantial rule of law. To realize substantial rule of law thoroughly,clear connotations of ＂plan＂ must be judged to seamlessly connect policy instruments with legal mechanism. Transformation of the birth control should be carried out by relying on the full exercise of constitutional provisions on this policy. Namely, The right way for the future modification of the birth control policy is to transform the single track system of economism stressing population control to the double track system considering the realization of social subject right in social development.
